OHDSI Alexa Skill Terms of Use

Please read these terms carefully before using the OHDSI Alexa Skill. Your attention is particularly drawn to the disclaimer and limitation of liability provisions in Clause 7 and the indemnity in Clause 8.

These terms of use (“Terms”) are a legal agreement between you (“you”) and OHDSI (“OHDSI”, “us” or “we”) in respect of your use of the OHDSI Alexa Skill (“Skill”) which enables you to receive information about OHDSI and other services provided by OHDSI. The Alexa service is made available by Amazon Digital Services LLC and/or its affiliates (“Amazon”). In order to use the Skill, you will first need to enable the Skill through your Alexa service (either from the Amazon website or the Alexa mobile application) subject to Amazon’s terms of use.

By accessing or using the Skill you agree to be bound by these Terms. If you do not agree to these Terms, we do not grant you permission to use the Skill and you should not proceed to download or use the Skill.

Please note that the information provided to you by the Alexa Skill is the latest available as of the date of your request.

Subject to you agreeing to abide by these Terms, we grant you permission to use the OHDSI Alexa Skill made available through the Amazon Alexa service.

We reserve all other rights which are not granted in these Terms.

The Alexa OHDSI Skill does not save or share any personally identifiable information.

You promise to us that: (a) you are authorized to agree to these Terms; and (b) your use of the Skill shall be entirely at your own risk.

All content available from OHDSI through or in connection with the Alexa Skill is the property of or licensed to OHDSI. Such content shall not be modified, distributed, framed, republished, scraped or sold in any form or by any means, in whole or in part, without our prior written permission. You acknowledge that all intellectual property rights in the Skill anywhere in the world belong to us (or are licensed to us), and that such rights are licensed (not sold) to you, and that you have no rights in, or to, the Skill other than the right to use it in accordance with these Terms.

Your interactions with us through or in relation to the Skill are subject to the OHDSI Alexa Skill Privacy Policy which is available on the OHDSI website.

The Skill is accessible through the Alexa service on an Alexa-enabled device. You acknowledge that we have no control over the functioning of the Alexa service or the Alexa-enabled device and we are not responsible for their availability or for any inaccuracies in your interactions with us through the Alexa service via your Alexa-enabled device. You are responsible for all costs associated with your use of the Alexa service and purchase of the Alexa-enabled device.

When downloading and using the Skill, you must not:

access, or attempt to access, parts of the Skill that are not intended for public use;
modify, adapt or reverse engineer any aspect of the Skill;
attempt to disrupt or interfere with the Skill in any way or with another person’s use of the Skill or use the Skill as a means of disrupting or interfering with the Alexa service;
probe, scan or test the vulnerability of the Skill;
insert or knowingly or recklessly transmit or distribute a virus into the Skill so as to cause harm to our sites, us or other users or which is likely to bring the Skill, our products our services or us into disrepute;
impersonate any person, or entity or misrepresent your affiliation with any person or entity;
assist, encourage or permit any other person to do any of the acts described above.
When a breach of these Terms has occurred, we may take such action as we consider appropriate in the circumstances.

Your use of the Alexa service and any Alexa-enabled device will be governed by Amazon’s terms and conditions and privacy policies (“Amazon Terms ”). It is your responsibility to read the Amazon Terms. If you do not understand or agree to be bound by the Amazon Terms, you should not use the Alexa service or any Alexa-enabled device. Where there is a conflict between Amazon Terms and these Terms, the Amazon Terms will apply to the extent of that conflict.

You acknowledge and agree that the information and advice that you receive from or in relation to the Skill may not be complete, up-to-date or reliable. You must: (a) make use of a wide range of information, advice and resources available to you; and (b) always exercise your own informed and reasonable judgment regarding the best course of action to follow. You acknowledge and agree that any actions taken by you, whether in reliance on the information received from the Skill or otherwise, are by your decision alone and are undertaken at your own risk.

Your results from using the OHDSI Alexa Skill (such as using the OHDSI Alexa Skill Covid-19 personal predicted outcome risk calculator) do not take the place of medical advice. Access to the OHDSI Alexa Skill information is for research and educational purposes only and is not endorsed by any medical professional. Your results are not a substitute for medical care and should not be used in place of an appointment or the advice of your physician or another healthcare provider. You are responsible for any action taken through the use of this information.

As the Skill is provided for domestic and personal use, we will have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We provide the Skill on an “as is” and “as available” basis. We make no guarantee that these will be uninterrupted, error free, or free from viruses or other harmful components. While we take reasonable precautions to prevent the existence of computer viruses and/or other malicious programs, we accept no liability for them. To the extent permitted by law, we exclude all conditions, warranties, representations or other terms, which may apply to the Alexa Skill whether express or implied.

You agree to compensate, OHDSI, its affiliates and each of its directors, officers, agents, contractors, partners and employees, harmless from any loss, liability, claim or demand, including reasonable legal fees, made by any third party due to or arising out of your misuse of the Skill and/or arising from a breach of these Terms.

You may terminate your use of the Skill at any time via the Alexa service by disabling the Skill from your Alexa app.

We may terminate these Terms and your permission to use the Skill immediately if: (a) you commit any breach of these Terms; (b) we discontinue the Skill; (c) we are prevented from providing the Skill for any reason, or (d) for any other reason as we see fit.

Furthermore, we reserve the right to change, edit, suspend, delete and/or cancel any part of the Skill at any time with or without notice to you.

We may change these Terms and/or the Skill at any time (for example to improve performance, enhance functionality, reflect changes required by the Amazon Alexa service, or to address security issues). Your continued use of the Alexa Skill means you agree to any new Terms and updates to the Skill.
